ARM – Águas e Resídos da Madeira, SA, in compliance with Law No. 93/2021, of December 20, provides the internal and external reporting channel to whistleblowers, guaranteeing them the conditions of security, secrecy, confidentiality of identity or anonymity and confidentiality of the identity of third parties identified in the respective reports, always preventing access to any information inherent to or emerging from the reports to unauthorized persons.
Under the terms of the Law, and in compliance with the General Regulation on Data Protection (GDPR), the whistleblower protection regime benefits the natural person who denounces or publicly discloses an infringement based on information obtained in the context of the exercise of his activity. professional in and/or for ARM, in particular candidates, employees, former employees and also service providers, subcontractors, suppliers (or any persons under their supervision), holders of shareholdings or members of statutory bodies, volunteers or interns (regardless of whether or not they are paid).
It should also be noted that the fact that the complaint or the public disclosure of a potential infringement is based on information obtained in a professional relationship with ARM, which has ended in the meantime, as well as during the process of recruitment or during another pre-contractual negotiation phase of an established or unincorporated professional relationship.
It should be added that the complainant has the right to know about the conduct of the complaint, the sequence of which must be made known to the complainant, unless expressly requested otherwise or in case this knowledge could compromise the protection of his identity. It should be noted that the acts and omissions considered to be an infraction may affect several matters, namely: i) public procurement; ii) financial services, products and markets and prevention of money laundering and terrorist financing; iii) product safety and compliance; iv) transport security; v) protection of the environment; vi) radiation protection and nuclear safety; vii) food and feed safety, animal health and animal welfare; viii) public health; ix) consumer protection; ex) protection of privacy and personal data and security of the network and information systems.
Denunciations of acts or omissions that are not carried out within the scope of Law n.º 93/2021, of December 20, and do not deal with its respective scope, will be filed for these purposes.
